These Terms and Conditions ("Terms") govern your use of wellwmn.co (the "Site") and any services, programs, or content offered by WELL WMN, LLC ("we," "us," "our," or “WELL WMN Nutrition”). By using the Site or purchasing our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

Our Services

WELL WMN Nutrition offers nutrition coaching, wellness education, and holistic aesthetic services for women preparing for pregnancy and in the postpartum period. These include virtual one-on-one coaching and, in select areas, in-home services such as postpartum body support and nutrition check-ins.

Not Medical Advice

Our services and content are for educational and supportive purposes only. They are not intended to diagnose, treat, cure, or prevent any disease, and they are not a substitute for care from a physician, midwife, or other licensed healthcare provider. Always consult your healthcare provider before making changes to your diet, supplements, or health routine, especially during pregnancy or while breastfeeding. Never disregard professional medical advice or delay seeking it because of something you learned from us.

Eligibility

You must be at least 18 years old to purchase services or create an account with us.

Booking, Cancellations, and Rescheduling

Appointments can be booked through us directly. We ask for at least 24 hours' notice to cancel or reschedule. Cancellations made with less notice, or missed appointments, may be charged the full session fee. We understand that life with a baby is unpredictable, and we may make exceptions at our discretion. If we need to cancel, we will reschedule at no cost to you or provide a refund for that session.

Payments and Refunds

Payment is due prior to your first session or according to your program's payment plan. Prices are listed in U.S. dollars and may change at any time, though changes will not affect services you have already purchased. Coaching packages and digital programs are non-refundable once started. If you are on a payment plan, you are responsible for completing all scheduled payments even if you stop using the services.

In-Home Services

For in-home services, you agree to provide a safe, clean, and reasonably accessible space. You also agree to share any relevant health information, allergies, skin sensitivities, or recent medical procedures (including your delivery type and recovery status) before your session, and to have clearance from your healthcare provider where appropriate. We reserve the right to decline or end a service if we believe it is unsafe to continue or if the environment is not suitable.

Client Responsibilities and Results

You are responsible for your own health decisions and for how you apply the guidance you receive. Every body is different, and we cannot guarantee specific results from any program, protocol, or treatment.

Intellectual Property

All content on the Site and in our programs, including text, guides, meal plans, recipes, videos, graphics, and our logo, is owned by WELL WMN Nutrition and protected by copyright and trademark laws. You may use materials you purchase for your own personal, non-commercial use. You may not copy, share, resell, or distribute our content without written permission.

Acceptable Use

You agree not to use the Site for any unlawful purpose, attempt to interfere with its operation, or share login access to paid programs with others.

Third-Party Links and Services

The Site may link to third-party websites or products, including our Substack and recommended supplements or tools. We are not responsible for the content, policies, or products of third parties. Some links may be affiliate links, meaning we may earn a small commission at no extra cost to you.

Limitation of Liability

To the fullest extent permitted by law, WELL WMN Nutrition and its owner are not liable for any indirect, incidental, or consequential damages arising from your use of the Site or our services. Our total liability for any claim related to our services will not exceed the amount you paid us for the service in question.

Indemnification

You agree to indemnify and hold harmless WELL WMN Nutrition from any claims, losses, or expenses arising from your use of our services, your violation of these Terms, or your failure to share relevant health information.

Governing Law

These Terms are governed by the laws of the State of Hawaii. Any disputes will be resolved in the courts located in Maui County, Hawaii.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Site or our services after changes are posted means you accept the updated Terms.
